The 300 and 867 are connection rates between the router and connected devices. Throughput is different. Look at the Status page and select WiFi, I believe you should see connected clients here and the connection rates...
Something to try, load up some 3rd party FW like DD-WRT or OpenWRT and see if there is any differences...

so I looked at the rates the phone is at 780mbs and the laptop apparently doens't have a rate

sadly no, both wi-fi bands do not live up to the advertisement

I would replace the router anyways, could be just faulty as well. Nobody else seem to post about this. I presume it could be used in limited fashion if needed.
