PS - I've tried re-flashing, tried down grading then upgrading, reset facotry defaults, powered on/off, changed fan settings back and forth, no luck.
I see that you tried reseting to facory defaults... did you reload the config from a saved file?I totally agree, learned this lesson first hand. :) They apparently just restore an image of everything, so it brings back your problem. Lame parameter saving process, it needs to be portable across firmware versions. ::)
If you did... then it would just "re-activate" the problem
Try reseting to defaults using the Reset button on the back of the DNS-323,
Then re-enter the settings manually... DON'T RELOAD FROM A SAVED FILE.
The settings are a bit "flaky".

I did the whole stuff again (1.08 firmware download, dated 12/18/2009, update, factory reset) but still without success. The fan spins up, stops and restarts with low speed at ~42° C. Later the plates hibernate and the NAS cools down but never stops anymore...

Where is the problem?Starting to sound like it. I guess you need to take a poll and see if it's only the guys with C1 hardware and 1.08 that are having the issue. :)
Hardware?
@DavidB
Make sure you do a reset using the button on the back and NOT reload config with previously saved file...
Because issue was resolved by multiple user after doing the reset... now I think they had the B1 version (I have B1) and no Fan issue...
I have the B1 hardware and have the same problem.Have you reset the box to factory defaults and done a manual reconfiguration? That's what I had to do. You can't reload the saved parameters, because you reload the problem with them.
What exactly did you do after hitting the reset button (cuz I reset that way last night and didn't reload any saved config -- I manually reconfigured). Did you mess with the power (hibernate / fan) settings at all? . . . or just keep the defaults?

I just did the above procedure and it all worked properly. You might try the fan in low/high, restart the box and then set it to off/low/high and see if that does it. This was a previous fix for fan issues, but mine worked with just the reset and config.
EDIT: Guess what! I downloaded and installed the fw 1.08 from the russian ftp site. With that the fan actually stops and stays stopped!
Did anyone ever bother to do a binary compare on them?
...it works correctly after restoring factory settings...
Ok, seems like I could narrow down the problem to Power LED control. As soon as I switch off (such that the blue Power LED won't light anymore) and reboot the DNS, the fan woun't be able to stop anymore. I was able to get it running again by enabling the Power LED control again (including reboot) without reset to factory default settings!
You would propose everyone of you to give it a try and post if it works. Would probably also help the developers to fix this issue.
Having programmed embedded systems for over 20 years, it escapes me how they managed to connect the fan to other events! This should be dirt simple, temperature too high, run the fan! ???
It would be nice to hear that D-Link is working on this and we expect a new firmware soon..
